Please note that you must cancel your Subscription before it renews for a subsequent month in order to avoid being charged for the next month’s Subscription Fee. If you cancel your Subscription, the cancellation will become effective at the end of the then-current monthly Subscription period. No Refunds  REFUNDS WILL NOT BE PROVIDED FOR ANY SUBSCRIPTION. WE DO NOT PROVIDE CREDIT, REFUNDS, OR PRORATED BILLING FOR SUBSCRIPTIONS THAT ARE CANCELLED MID-MONTH.

Use of Service: Subscribers agree that no provided services are used for illegal purposes. Any subscriber using our provided services illegally will be subject to immediate cancellation of all services without prior notice.

Rates and Terms: Quoted rates are determined by the initial information provided by subscribers and are subject to adjustment at the time that a subscriber notifies One Answering Service with instructions for the account. The service agency reserves the right to a 10% annual increase.

Telephone Number Assignments: The subscriber has no proprietary rights to their assigned telephone number. The subscriber understands and acknowledges that all telephone numbers are provided on a rental basis only and are the property of the service agency unless otherwise agreed upon. Assignment of a telephone number in advance of service is not guaranteed until service activation. All numbers are subject to change by the agency, therefore, the subscriber acknowledges and accepts the potential risk of publishing and/or distributing their assigned number.

Minimum Contract Period: The subscriber agrees to use the service for an uninterrupted period of one month and understands that service automatically renews on a month-to-month basis unless canceled via email by the subscriber prior to the account’s monthly billing date.

Effective Date: This agreement will become effective on the day the subscriber first receives services.

Billing: When service commences, payment for the first month of service is due. Thereafter, all base rates will be billed in advance on a monthly basis. Additional charges are billed monthly as incurred. The agency considers accounts delinquent when not paid by the tenth day of the month and are subject to a $10.00 bookkeeping fee. This fee will continue every month until the account is up-to-date. Fees not paid by the 15th of the month may result in termination and/or interruption of service without notice.

Billing Discrepancies: The subscriber must notify the servicing agency’s billing department within 30 days of the invoice date. No adjustments are considered beyond the 30-day period.

Monthly Call Allowance: The subscriber’s base rate call allowance includes all answered calls including messages, non-messages, callers asking for company hours, hang-ups and other calls.

Returned Checks: The subscriber agrees to pay a service charge of $25.00 for any check returned by the bank, regardless of the reason.

Collection Agency Fees/Attorney Fees: The subscriber agrees to pay all costs resulting from any legal dispute and/or the collection of monies due. The prevailing party in any legal dispute will be entitled to damages and attorney’s fees.

Confidentiality: The agency will treat all messages as confidential. However, the agency will cooperate with all law enforcement agencies to disclose any required information regarding the subscriber.

Retention of Messages: The agency extends significant effort to archive messages for at least 60 days from the date of origination. However, the agency makes no guarantee that messages will be preserved beyond the original date of delivery to the subscriber. The telephone operators enjoy access to the most current 5 days of messages. Any message requests beyond 5 days old must be directed to a supervisor.

Duplicating of Messages: Upon request, the agency will provide duplicate message copies for a fee of $20.00 plus postage.

Permanent Account Changes: The subscriber agrees that all permanent instructional changes regarding the account shall be delivered only to a member of the agency’s management. The subscriber may make changes either verbally or in writing and acknowledges that while telephone operators may accept a temporary information change as a courtesy, they do not possess the responsibility nor the authority to implement permanent changes.

Interruption of Service: All precautions will be taken to provide continuous, 24-hour service. By signing up for service, the subscriber acknowledges that uninterrupted service isn’t guaranteed. Service interruptions may result without notice due to electrical outages at the facility, telephone utility service failures, natural disasters, including floods, fires or earthquakes, order by law enforcement or public agency for evacuation of the premises or equipment malfunctions. The sole liability of the agency to the subscriber in the case of any such interruption is to provide a pro-rata credit based upon the monthly service rate for each 24-hour period of interrupted service.

Errors and Omissions: The agency is not liable to the subscriber or its callers for errors or omission in the transmission of calls due to difficulties that can arise when transmitting verbal messages over the phone.

Limitations of Liability: Fees paid to the agency are based solely on the value of the services and the scope of liability set forth is unrelated to this value. The subscriber agrees that the maximum financial liability of the agency shall be strictly limited to the charges billed for providing services during the monthly service during which a claim arises. In no event shall the servicing agency be liable for special or consequential damages but not limited to loss of a prospective sale, loss of profits or third-party claims against a subscriber.
